HIGHLIGHTS OF THE PROPOSED RESTRICTIVE COVENANTS Old Millstone Landing will have a Declaration of Restrictive Covenants governing the community. These Restrictive Covenants will be recorded in the Onslow County Registry. Some of the relevant portions of the anticipated Restrictive Covenants are set forth below. A full set of Restrictive Covenants will be provided upon completion. 1. A Homeowners Association will be created, with monthly assessments of $20.00. The Association is responsible for maintenance of all common areas, including all common improvements within Old Millstone Landing. In addition, the Association shall operate all amenities, if any, within Old Millstone Landing. The Association will have the right to place a lien on all lots to enforce payment of the assessments levied by the Association. The Association will be governed by a Board of Directors. The Developer will have the authority to appoint the Board of Directors for an extended period of time. The Homeowner Association will have annual membership meetings. All of this and more shall be set forth in the Homeowner Association’s By-Laws, which will be provided upon completion. 2.
There will be an Architectural Review by the Developer, which will
review and approve all construction and all improvements on any lot in Old
Millstone Landing. The
decision of the Architectural Review Committee will be final.
A $100.00 non-refundable fee must accompany all plans submitted for
Architectural Review. 3.
There will be a minimum square footage required for houses in Old
Millstone Landing of 1600 square feet air conditioned space above grade
not including garages. Anticipated
setbacks are set as follows: Front Yard: 25 Feet Minimum Side Yard: 8 Feet Minimum Rear Yard:
15 Feet Minimum from the rear lot line; 4.
An Architectural Review is required to authorized most any
improvements to the Lots. In
addition, all Owners shall be responsible to comply with all rules and
regulations of any applicable governmental authority. 5.
There will be ordinary rules and regulations governing life in Old
Millstone Landing. Matters,
which will be subject to regulation include: structures, vehicles and
parking, signs, and other matters common to regulation in high quality
residential developments. 6.
A $500.00 construction deposit will be required when final house
plans are submitted. This
amount is refundable upon completion of home construction is compliance
with the Restrictive Covenants and the Architectural Review Guidelines.
The construction deposit may be used to offset any costs incurred
by the Association of the Architectural Review such as repair damages; pay
for the cost of any cleanup to bring home site into compliance with
requirements of the Covenants; to recover association legal fees; and pay
any fines or penalties when such costs are associated with non-compliance
with the Restrictive Covenants.
